Terms and Conditions The following General Terms and Conditions govern the contractual relationship between the Guest (hereinafter the "Client") and BNB EXPERT di Franco Simonelli (hereinafter the "BNBEXPERT") following the booking and payment of the accommodation chosen from those present on the portal www.bnbexpert.it (hereinafter the "Site") directly or indirectly, via any mobile device, by e-mail or by telephone. The following general terms and conditions govern the terms and conditions of the agreement between BNBEXPERT and the Client who books and purchases services via the Site, as well as the transient rental contract concluded between the Client and BNBEXPERT, which acts in the name and on behalf of the owners of the accommodation, and which concerns the chosen accommodation. The Client is obliged to accept these General Terms and Conditions and Terms of Use and the specific conditions relating to the accommodation or individual services (such as duration, price, applicable taxes and current legislation). The customer is therefore obliged to read the General Terms and Conditions and Terms of Use in full, as well as any special conditions applicable to individual services, made available on the Website before making a reservation. By making a booking or purchasing a service offered by BNBEXPERT you automatically accept the General Terms and Conditions described herein. The General Terms and Conditions may be changed at any time, without prior notice, it being understood that such changes will not be applied to orders placed by the customer prior to the change.
Booking Modalities By accessing the online platform www.bnbexpert.it, the Client can view and consult the availability and real time prices of accommodation managed by BNBEXPERT or its Partners. If the chosen accommodation is free for the period selected, the Client must pay the amount shown in the order summary by credit card following the guided instructions in order to conclude and confirm the reservation. Upon successful payment, BNBEXPERT will send the Client a Booking Confirmation email containing details of the amount paid, the duration of the stay, the number of occupants as well as any compulsory or additional extra services. The reservation will not be confirmed until the payment has been successfully made (in accordance with the terms governing the Cancellation Terms) and the Client has received the Booking Confirmation email.
Rates and Payment The rental rate for rentals of less than 30 nights is indicated in the Order Summary, which also shows the amounts for cleaning and ancillary services. For rentals of less than one month, the total amount must be understood to include energy, gas, heating and water consumption. The balance of the amount of the stay for the period indicated shall have already been paid in full by the Client to BNBEXPERT at the time of booking by credit card payment or shall be paid prior to check-in in accordance with the times indicated in the "Cancellation Policies". Extra Costs refer to the optional services offered by BNBEXPERT and chosen by the Client, these services will be invoiced with VAT at 22% as per law. The rate does not include tourist tax, which must be paid by credit card at check-in in accordance with the regulations of the municipality where the accommodation is located.
Cancellation Policies There are two types of rates on the Site: refundable and non-refundable. For the refundable rate, no amount will be due at the time of booking. The customer may cancel or modify the reservation up to a maximum of n° days before check-in (indicated in the Cancellation Policy section). In case of a partially refundable rate, % of the total cost indicated will be charged in case of cancellation after booking. The total cost of the booking will only be due in the case of cancellation after the period indicated before check-in. Failure to show up for check-in will result in payment of the total cost of the reservation. Non-refundable rates are non-changeable and prepayment of the entire stay is required at the time of booking. In case of cancellation or modification, the full amount of the stay will be charged. Any request for a change in the reservation is subject to approval and availability by IBNBEXPERT or the managing partner of the accommodation and subject to notification by email to [email protected] or telephone request to the Booking office of BNBEXPERT. In the event of a request to change the dates of the stay, the number of guests or a change of accommodation, supplements will be charged according to availability and depending on the period of the stay.
Check-in and Check-out Rules The client must confirm the check-in time in the manner indicated in the Booking Confirmation email or through communications sent by BNBEXPERT prior to arrival. Check-in will take place according to the defined times and in two ways: at the flat or at the Welcome Point. At the time of check-in, the Client will hand over to the BNBEXPERT representative the identification documents for each adult and minor who will be using the accommodation for identification to the security bodies (State Police). The identity documents valid for this purpose are: identity card or driving licence for Italian and EU citizens, passport for non-EU citizens. Failure to produce the identity documents of each guest will result in them being banned from the accommodation. The Client undertakes not to accommodate a greater number of persons than that indicated in the Booking Confirmation. Failure to comply with this obligation will result in the Client being obliged to pay BNBEXPERT a supplement per extra person and a penalty of EUR 100.00 per day. The Client undertakes to sign - in virtual or paper form - the Rental Contract, which shall be drawn up in accordance with the regulations in force on the national territory (DL 431, 9 December 1998). The contract will be viewed and signed in virtual form by means of authorisation via SMS with a unique OTP (One Time Password) code that will be delivered to the guest's mobile phone number, a private device associated with the person that thus enables the unique identification of the signatory. The signature affixed via OTP Service is an advanced electronic signature (FEA) and has the same legal validity as an electronic or handwritten signature. The service is provided by Fractalgarden Srl, which has delegated the management of personal data such as email and telephone number for the sole purpose of the service. By signing the contract you accept the conditions, the rules of the Accommodation and the condominium regulations. For bookings of less than thirty days, a credit card will be requested as a guarantee against possible damages (Postepay, Debit Card or prepaid cards of any kind will not be accepted). In case of lack of a credit card as guarantee, a cash deposit will be requested, which will be returned after checking for any damages in the flat. The Client agrees to allow the person in charge of BNBEXPERT, and/or third parties appointed by BNBEXPERT, identifiable upon the Client's request, to access the accommodation in order to carry out any necessary repairs and/or maintenance. Except in cases of emergency, the Client shall be informed in advance via his contact details and, if he does not respond in time, the person in charge of BNBEXPERT shall have access to the accommodation. The return of the keys is compulsory according to the modalities that will be communicated at check-in and according to the availability of BNBEXPERT staff.
Security deposit When provided for and explicitly indicated in the "Extras" section of the accommodation detail page on the Site, upon handing over the keys, the Client pays the check-in agent the amount of the security deposit. The security deposit required depends on the duration of the lease, the type of accommodation of particular value and/or the presence of animals. The security deposit shall be returned to the Client in full at the end of the stay, after termination of the Contract. It is understood that, in the event of ascertaining damage caused by the Client to the accommodation, BNBEXPERT shall be entitled to retain the security deposit, without prejudice, in any event, to its right to compensation for any greater damage.
Replacements BNBEXPERT reserves the right to propose the replacement of the accommodation with another of equal or superior quality if, for reasons beyond its control, it is unable to ensure the Client's entry into the property and stay in the manner indicated in the Booking Confirmation. Non-attributable causes include, for example, sudden plumbing problems that have arisen, failure of the contractor to clean the property, or any other reason that makes it impossible for the Client to stay in the accommodation to protect his or her safety. In the event that accommodation of the same value as that booked by the Client is not available, the Company reserves the right to ask for a supplement to the cost previously paid by the Client.
Rules of the Accommodation The Client undertakes to use the accommodation with care, keeping it clean, refraining from any act that may cause any damage to it and/or its appurtenances and/or common parts and/or property contained therein. The Client agrees not to disturb the residents in the apartment building during his/her entire stay in the accommodation. It is prohibited to use the Lodging for illicit acts, to reproduce and/or hand over to third parties the keys to the Lodging and/or to reveal to third parties any access codes to the Lodging. The loss/breakage of keys and/or lock shall entail the reimbursement of the cost of a new lock and 5 new sets of keys. The Client undertakes to observe, throughout the rental period, the ordinary precautions and security measures designed to prevent the entry of strangers into the Accommodation. It is understood that in the event of failure to comply with this obligation, the Client shall be liable for any damage caused to the Accommodation and/or the property contained therein. Unless expressly authorised in writing by BNBEXPERT, the Client is prohibited from accommodating animals of any species.
Smoking is strictly prohibited inside the Accommodation. In the event of violation, a fine will be charged as indicated in the Annex to the Contract. Obligation to separate waste In order to reduce the impact on the environment and to comply with current regulations, it is the Client's responsibility and obligation to effect the proper separation of waste in accordance with the indications of the municipality of reference or, where present, those within the Accommodation. For stays of 1 to 3 nights, waste may be left inside the Accommodation and will be disposed of by the cleaning company. For stays of 4 nights or more, the Client must dispose of the waste himself/herself in the appropriate communal areas. For any doubts the Client is requested to refer to the receptionist who checked in.
Reservations longer than 30 days Requests to reserve accommodation for a period of time longer than 30 days must be made by completing the appropriate form on the Site under "Long-term stays". The Client will be contacted by BNBEXPERT, which will send an estimate and make one of its representatives available for free inspections of one or more flats. The reservation will only be concluded once the Client has signed the Rental Contract. Before that date, no flat will be blocked or optioned. The rates are non-refundable and an advance payment of the first month's rent, security deposit and initial and final cleaning is required at the time of booking. Payment can be made by credit card or bank transfer.
Penalties & Limitation of Liability In the event of conduct contrary to the good management of the property, the Client shall pay BNBEXPERT a penalty equal to 200% of the rent indicated in the preamble, and the Company shall also have recourse to the security deposit, without prejudice to the right to compensation for any greater damage suffered. BNBEXPERT shall never be liable for any theft suffered by the Client, whether by breaking and entering or tampering at the entrance or in any other manner within the Accommodation. The Client therefore undertakes not to leave his or her property and personal effects unattended in the Accommodation. BNBEXPERT shall not be liable to the Client for any suspensions and/or interruptions in the supply of electricity and/or gas and/or water and/or Internet.
Processing of personal data The Client authorises BNBEXPERT to disclose his/her personal data to third parties in connection with fulfilments connected with the rental relationship (D. Lgs. 196/2003). For privacy please read this link www.bnbexpert.it. For any dispute arising from this assignment, the Court of Milan shall have exclusive jurisdiction.
